In an interview with Estadão, André Fonseca affirms that the leaked intimate video Neymar shared of the woman who accused him of rape constitutes a crime. Although a majority of lawyers argue that Neymar did not commit a digital crime since the shared images were blurred and thus there was no nudity as is required by the Criminal Code to classify the act as a crime, Fonseca asserts that the blurred face of the accuser lessens but does not disqualify the crime: “The fact that the face does not appear is a good defense argument. It is harder to prove. The victim would have to prove she was being slandered. But this does not mischaracterize the crime.”
