On 24 May, the National Authority of Protection Data (ANPD) published Pronouncement CD/ANPD No. 1/2023 which resolves one of the more controversial points of the General Data Protection Law (Law No. 13,709/2018 – “LGPD”) regarding the processing of personal data for children and teenagers.
“The data treatment for children and teenagers may be realized on the legal hypothesis in article 7 or in article 11 of the General Data Protection Law (LGPD), as long as their best interest prevails and is observed, to be evaluated in a concrete case, in accordance with art. 14 of the Law.”
