The new Federal Law nº 14.016/2020 allows hospitals, supermarkets, restaurants and other companies supplying food ready for consumption to donate their surplus as a way to combat food waste. Some criteria have been established to ensure the products are fit for human consumption, and these donations can be made through intermediaries such as food banks and other associations. Nonetheless, food surplus donors and intermediaries can solely be held liable for damages if they act in bad faith since the donations do not constitute consumer relations.
