The recent work “Arbitragem e Processo – Homage to Professor Carlos Alberto Carmona (Arbitration and Process – Homage to Professor Carlos Alberto Carmona) – Volume 2”, features an article by our Data Protection and Technology partner, Clarissa Luz, written in co-authorship with lawyer Nathalia Mazzonetto, called “DATA & ADR: Cenários e Potencialidades – Adequação como Resposta (DATA & ADR: Scenarios and Potentialities – Adequacy as an Answer)”. The co-authors explain the importance of choosing private mechanisms for the resolution of conflicts related to the protection of personal data, in particular settling disputes between data processing agents (controllers and operators), considering, among other aspects, the joint and several liability provided for in the national General Data Protection Law (LGPD) and the confidentiality of the matter. The text addresses the intersection between data protection and appropriate means of dispute resolution (ADRs), including mediation, arbitration and technical committees as appropriate tools.
