After the Federal Supreme Court’s decision regarding the collection of Difal (rate differential), Viveo could have a bill of BRL 450 million.
In the last week of November, Supreme Court ministers decided that this charge should have started in April 2022, which differs from the opinion of taxpayers who defended a start in 2023.
For now, Viveo awaits the STF’s ruling.
Consulted by Brazil Journal, Gabriel Paranaguá, partner in the Tax area at Felsberg Advogados, says that “A motion for declaration may be filed against the decision, depending on what will be contained in the ruling to be published, but it is very difficult to change a decision.”
